Rules question for 5 card draw type games

It is the initial dealing of the cards. You are playing any of the 5 card triple draw type games, such as 2-7, badacey, Archie, etc. If you notice you only have 4 cards, or have 6, and there is no substantial action yet, it is a misdeal. But what if there has been substantial action I am 100% sure that if you now realize you have 6 cards, your hand is dead, and the rest of the table plays on. But what if you have 4 cards Are you allowed to play with 4 cards If you discard 1 on the first draw, the dealer will give you 2 I'm fairly certain the correct ruling is your hand is dead. But am I wrong And should I be wrong; why not allow you to play on and make up the deficit on the first draw Thanks for your thoughts.

From a fairness standpoint, there’s no reason to not just immediately deal the player the top card from the deck. There’s no advantage to the player and avoids punishing them for a dealer error. This is a strictly better solution than filling their hand in during the draw, which puts the player at the disadvantage of starting with one fewer card.

The only argument I see for declaring the hand dead is from a game integrity perspective. That is, that dealing cards to players outside of the natural order of the shuffled deck introduces perceived opportunities to manipulate the deal.

In practice, I’m not certain is actually easier to force a card to a player in this manner. Placing a specific card 29 cards down the deck seems as easy as placing it anywhere else; it would seem easier to deal from the bottom of the deck or commit some other form of false deal in the middle of a standard deal than when everyone is watching the dealer correct an earlier mistake.


I agree with hard. If it were me, just give him the top card. I imagine you’re gonna get a lot of pushback from players that it was not supposed to be “his card” and I imagine the standard floor ruling is going to be dead hand like it would be in hold em

A very similar scenario happened to me in a Badacey hand recently. I’m on the button, UTG raises, I look down and only have 4 cards. Dealer gives me the top card off the deck. Next player calls, and it’s at that point that SB realizes he has 6 cards and must have taken one of my original cards.

Floor ruled substantial action had taken place, so hand continued. My hand was live but they killed SB hand. Floor also paid SB back their blind from the card room.

I ended up scooping that pot with a 6 low 5 dugi.
