Sure, but he would have been required to explain the payment in what is in essence a public disclosure form if he used campaign funds.
My read is it is clearly a personal expense that he tried to hide from his wife by running it through his real estate business. If Trump wasn't such a cheat, he would have simply declared it as income rather than a legal expense.
No need to strawman with the legality of the payment for non disclosure, no one is disputing that.
