He is still charged with second degree murder at the state level, and first degree murder at the federal level. If I was him, I dont think I would be celebrating anything.
I agree it doesn't really make a huge difference, as afaik he can still get the death penalty on the federal murder charge, although I'm not 100%. Even at the very best scenario he'd still get 25-life, with the emphasis on life.

My wife has a few friends in her social circle that went this route to varying degrees, and none of them are conservative/Republican.
On top of this, there is some percentage of recent immigrants from South/Central America without vaccinations.
There's always been a rightwing sliver as well. Just like when most ordinary conservatives were calling organic food etc a commie plot back in the day--there was still ~10% or whatever that would reg. be shopping at natural food stores etc. The avg conservative just wasn't nec. going to be running into that group too much(or paying that close attention if they did).
