Tax question on poker winnings - UK citizen
Hi all,
I hope you are well.
I am going to Vegas at the end of June.
I understand that there is a tax treaty between the US and UK. Does anyone know the up-to-date situation as to whether I need to apply for an ITIN or the best course of action for me to take?
If I win a tournament or playing cash games, what happens? I have been to Vegas once before and never had anything withheld when I cashed out at the desk after playing cash games. I do plan on playing some bigger tournaments though this year.
Is it possible that casinos withhold tax and then I have to claim it back?
I believe that it used to be the case that you would ask for a W8-BEN and then get the casino to give you a TIN. You would then fill out a few forms and give your ID. Is this still the case? Is there a way for me to do this before travelling to Vegas to save time?
Thanks.

Does anybody (UK or otherwise) know if the ITIN situation was sorted for WSOP 2023?
Or otherwise, any reasonable routes to take in Vegas if WSOP won't issue. I've looked into applying for an ITIN from the UK but it costs £500+ so prob not worth it (in case I don't end up cashing).
I'm going for the first time in 15 years this year and would love not to deal with the stress and uncertainty if I do manage to cash!

ITIN situation wasn't fixed as of last WSOP at paris or the venetian that im aware of. Cashed at the venetian and was withheld x amount. Applied for the ITIN myself and filed a tax return sent it off a few weeks ago cost me zero except for postage. The forms looks daunting but if do enough research and send off your passport it can be done for free.

Really appreciate the response. I think this thread will help others in my situation going to WSOP for the first time this year. Just a couple of questions:
How did you apply for the ITIN? If you sent off your passport, I suppose that means you did so after you'd returned from Vegas. If it was free except for postage, I guess that means you did it through the IRS and not through one of these companies which charge a few hundred?
It sounds like applying for the ITIN and sending off the tax form are separate processes, done one after the other?
Any particular reason you did it as late as a few weeks ago? I'm guessing it's because the application process has a long turn-around time.
Cheers
There was a thread in here somewhere that was talking about just going and hitting a handpay at Wynn or somewhere and they will issue one for you on the spot.

Yes as i cashed in 2023 you have to wait for 2024 to file the previous years tax return. Was direct with the IRS downloaded forms 1040-NR and W-7 filled them in myself and sent my passport off all together. Obviously most people won't want to be without their passport for however long. Im fortunate to be a dual citizen so could send off the UK passport and retain another for travel.
Did look into having a certified acceptance agent do it but they wanted a fortune the nit in me refused to fork it over. Few links below which should help.
Hey guys, bumping this as I'm a UK citizen considering a trip over to vegas for the WSOP grind. Whats the best way to obtain an ITIN now to avoid paying the 30% tax? Will WSOP help me with it directly, or is there some other way to get it quickly?
Unless anything has changed, that is not and has never been a thing in the UK

Update got my passport back in the mail yesterday and today received my ITIN process took around 6-7 weeks from when i sent it and was fairly painless. No need to pay someone a fortune took me a few hours research and £10 postage.
Hi Guys,
Theres anyone with problems to receive the tax return from 2022?
Me and some friends paid to Kondler and Associates in the end of the series 2022 and they are informaintg that IRS is late since then.
2 Years passed and the situation starts to be a bit strange.
Last email they sent to us, said that Will check once again of 25th May our situation.
Anyone had problems?
Cheers
Bumping this.
I am a cash game player and decided to play a MTT in Miami, cashed it and they withheld the 30% of a min cash, not big enough to be annoyed about but annoying process given its so complicated to facilitate a rebate/get the ITIN.
I was thinking of coming to the wsop this year but likely will not bother as the thought of running like god only for them to then withhold the 30%, not provide an ITIN and I need to file a US TR to reclaim it seems annoying, but if WSOP issue the ITIN on the spot and give you all of your gross winnings I would come.
Any one know if they are doing this for 2025 and who I can speak to to get it confirmed they will issue ITIN and not withhold tax - obviously if you bink huge you’d just pay a CAA to do it all and wait for your money but it is slightly less appealing than getting the whole lot on the spot.
Hypothetical dream situation obv, likely do your bollocks and never need an ITIN lol
They helped me with my ITIN last year and did not withhold anything.
Maybe ring Paris main cage to confirm if they’re doing the same this year. (I would assume yes but better to make sure)

inter's dont get anything withheld...
Yeah they do. Where are you talking about specifically - Vegas? Because 2 weeks ago in Miami at the Hard Rock they withheld 30% from me as I didn’t have an ITIN number was a non negotiable they would refuse payout entirely if I didn’t accept it minus the 30%
