I was (regrettably) listening to an interview with AG of CA, who is suing trump admin for sending in the national guard.... journalist Amy Goodman asked him if newsome could order the troops to leave.
he gave a dodgy answer that sounded like newsome could order them to leave but is too chicken **** lmao
he said the governor is the commander in chief of the guard... which is weird cuz it's called the national guard, not the state guard... but anyway he is the AG of CA, so he should know, right?
so yeah he said governor is the commander in chief unless there are some requirements met that let's the president take over. like if conditions on the ground are preventing govt from enforcing laws, then president can take over the national guard from the governor
and trump is basically claiming this is the case. and that is why the CA AG is suing, claiming it's not the case.... but if they really believed it was the case, they'd just order the troops to leave. but he said they want to let the courts decide lmao
It's reasonable not to give an order like that if you're not sure it'll be followed. The worst case scenario of a military unit getting conflicting orders in a situation where there's disputed authority is pretty bad news. Imagine those newly deployed Marines & the national guard at odds in LA, for example. Probably pretty extreme and unlikely, but not impossible, and I think you want to be as tight as possible here
I totally agree you shouldn't give an order like that if you are a servant to the status quo, and the wealthy dominating the working class.
but if you see we are clearly living in a completely unjust society where rich ****s call in men with guns to brutalize workers on whim, then you order your men with guns to not do that

it just shows that all these bs protections are totally fake. we are just completely at the mercy of the rich and powerful. they will do whatever they want, and there's nothing any of us can do about it.
My argument is that they shouldn't give the order if they aren't certain the soldiers will follow it. If there's any confusion in the leadership ranks about whether or not they should follow Trump or Newsom's orders if they disagree (and there probably is), then giving them a conflicting order is creating a dangerous situation. It's smart to get a legal judgement on it.
Anyway, I need to go shower after giving Newsom the benefit of the doubt.

I don't know specifically what US soldiers are taught. Canadian soldiers are taught that they can & should disobey illegal orders. The culture of the military is such that you realistically have to be very sure that the order is illegal before declining to follow it, because you're definitely going to be arrested and tried if you do.
Realistically, these orders need to be declined at the top - and part of Hegseth detaching/firing the JAG corps in a lot of places is to remove that legal advice. You can't expect a 21 year old kid to say "No" when their superior tells them to do something that's come down the chain of command. It's too late by then
again, I totally agree it's creating a dangerous situation to give an order like that the soldiers might not follow, probably won't follow even.
but my point is that we are already in a worse situation. we, meanign working people, especially poor people. we are being snatched up and deported. we are in jail, homeless, slaving our lives away for unfair wages. cops and military are keeping us from even protesting... etc etc
but people like Gavin newsome are not in a worse situation. they are living in mansions and having servants do everything for them. so they're not gonna do things like order the military to leave people alone, even if the president illegally(lol at what is and isn't legal) orders the military to the street of LA
there was a US officer who refused to deploy to Iraq because it was an illegal order. as far as I can tell the courts were like "ok... I guess?"
this was like 2006. my guess is that if some **** like that were to go down these days, that soldier would go straight to prison
but I would have guessed he would have went to prison back then too, and any time in this great nation's history of justice and freedom
Idk much about Gavin Newsome. It's giving Mitt Romney tho. Wants to be President, his motivations will flow toward that outcome.
