As far as being a American from California what is the solution? What can I do to make an effort to help poker and the community? The fact someone took the time to put this change in the bill is crazy. It's also absolutely ridiculous that a professional player wouldn't be able to net their losses ... what other business or profession isn't allowed to net profits and losses? Ridiculous.

I was at a bar last night and people (who don't play poker) were asking me about it, and I have found I can cut through the muck with a simple example: "Say you enter 5 tournaments at $10K apiece, and you cash in one of them for $50K. So, $50K in, $50K out and you net exactly zero dollars. Under this law, you now owe the government taxes on $5K that you never received."

It's always funny to see how little people understand about tax law. So many people, including Phil Galfond, saying people will just move to "offshore" sites. This makes little to no sense.
First, gambling winnings on offshore sites are taxable, just the same as regulated sites. You are still technically required to report the income. So you re not avoiding having to pay tax.
Second, if you do chose to underreport gambling income on your tax return (which the vast majority of gamblers already do), there is no difference in betting on regulated vs offshore sites (EXCEPT FOR POKER TOURNAMENTS). Regulated sportsbooks and online poker rooms (cash games) do not report to the IRS. You are not gaining any advantage playing offshore. Either way, income is not being reported to the IRS, and it's up to you to accurately report, or not report, your income.
Online poker tournaments are the exception, where regulated sites do report tournament winnings over $5K.

What if you play from abroad? Wouldn't the foreign earned income exclusion take care of this problem, since the first $120K+ is not taxed? I know you still have to pay payroll (ss+medicare) on foreign income, though.
