I'd say he is better classified as a political nomination. He is a Yale law grad who is extremely loyal and extremely ideologically driven by Rightwing principles. Those types of people, who can be used as operatives on the court, don't grow on trees. Political extremism isn't super common in the top 3 law schools. They are like 95% just generically pro establishment. Thomas had a real axe to grind against the Left. If I was an arch conservative looking to appoint someone for political reasons I would go with him over some mealy mouthed regular person who was at the top of his class instead of the middle.

He was referring to debate and organizing people democratically. When people no longer have access to that, the inevitable result is violence. It’s a warning against making dissent illegal, which is what Trump and others who don’t respect the first amendment want to do.
