Can we let employers decide what to use to judge if an employee is a good fit or not? they are the people who pay they should have complete discretion in who to hire and keep with no third parties ever having a say at all (yes i am against *all* anti-discrimination laws in private hiring).Now we should discuss what public employers should do... and that should be decided by vot

Sure we could, but it's not good economics. It reminds of the of question when it comes from left wing cancel culture, what are you supposed to do with people who become de facto unemployable because they're deemed racist and so any job they get presumably there's going to be some kind of pressure campaign? Again presumably they've got to good at something and could be doing something, if not for the fact of them being deemed racist. There's value being left on the table there. That's the value add of free speech from a free markets perspective, it better aligns workers with their skills.

The roommate destroyed the note Robinson left under his keyboard. That's accessory after the fact. Robinson is also charged with witness tampering re instructing the roommate to delete stuff. Whether the roommate did or not it doesn't say, but if he did that would also count as accessory.

And people are getting fired for saying Charlie Kirk wasn't the nicest guy? How is that not a slam dunk wrongful termination suit? You can't fire people for calling some racist hatemonger what he was, not legally anyway.

Under US at-will employment law, you can be fired at any time for any reason or none. Your only redress would be in case of provable breach of contract or discrimination against a legally protected characteristic. And disliking Charlie Kirk is not a legally protected characteristic. Several people in sensitive positions, such as the media and the Secret Service, have been fired for ill-considered sectarian statements which could be taken as celebrating political murder, harassing the family of a murder victim and even inciting communal or political violence.

People can only sue for wrongful termination if the reason they were terminated relates to a protected class/protected activity. Political activity is not protected with respect to employment. (This is for at will employment)

Now if you have an employment contract that’s different.

I definitely think if you cheer on Kirk’s death it’s sort of a FAFO situation there. But this guy literally just had the most normal criticism of Kirk and Republicans and even said that it was a horrific thing that shouldn’t have happened.

I hope the outcome of this investigation is not giving in to the mob of the cult of Kirk.

You understand in the USA you can fire someone for his political opinion right? that's not a protected class.

The left fired people because they donated to rittenhouse defense.

Really? The Left did that? I don't believe it. That would make me politically happy and one thing I've learned about politics is I'm not allowed to be politically happy.

I think - and I am open to correction here if Rococo wants to chime in - that in order to avoid a wrongful termination suit you'd have to link the employee's political opinions to being in violation of company policy or federal law regarding protected classes and discrimination. Not liking a particular Christian fascist would not violate any policy that most any company would implement.

In an appearance on Fox News' "Fox & Friends," Patel said investigators believe Tyler Robinson also wrote a physical note saying he had the "opportunity to take out Charlie Kirk" and would do so. The note was destroyed, Patel said, but investigators have collected forensic evidence that it had existed and confirmed its contents through interviews.

I normally don’t reply to people who do drive-by comments and won’t defend their beliefs, but I’ll make an exception.

Charlie Kirk said that we should repeal the civil rights act, and made many inflammatory statements about race that would have gotten him fired from a normal job, like saying you benefited from affirmative action is admitting black women are neurologically inferior. He also called the great replacement theory, which is broadly viewed as racist, β€œthe great replacement reality”.

Sorry but you don’t get to launder someone’s public statements just because they were brutally murdered. Many people will see Charlie’s comments as racist and it should be a normal political opinion that someone can express. Just like the right calls Democrats racist all the time!

He didn't say it shouldn't have happened. He implied that it should, just that the video was a bit shocking. If you work in law enforcement you can't publicly say things like that.


So you can fire people because you don't like their haircut? Looks like I had a totally wrong conception of what wrongful termination meant. So there are a few set aside reasons you can't fire someone, but outside of that the entire universe of reasons is valid (and if under contract other rules apply).

Between learning this and that groypers are into trans women because they are scared of biological women (or more likely homosexual probably) this thread has been very educational.
