If you believe this, it's only because you believe the shots were so close together in time as to effectively simultaneous. If there had been a twenty second break between the shots, then surely you would not be making the argument that only the decisionmaking as to the initial shot was relevant.

Its clear he acted unlawfully but can you find a jury of 12 that would convict him? I think you would need to focus on the second and third shots but I bet you get a hung jury every time
I found it more problematic that he will probably never face charges than whether a jury convicts him or if the jury hangs. In normal situations, I would trust federal prosecutors more than state prosecutors to do the right thing. With those in charge now I have no faith in them and expect federal pushback if the state pursues any charges here.
