The Supreme Court discussion thread
7 States have passed bills this year which place new restrictions on abortion. Alabama's new law, in particular, is a ne
I don't have any numbers to back this up, but I would guess the percentage of babies born here due to 'birth tourism' is about as small as the percentage of fraudulent voters.
Are people still under some delusion that the supreme court is primarily a legal power rather than a political one? Or do they just like to keep up the pretense?
I agree but I cant imagine the fore fathers oh sorry Fore people could ever imagine birth tourism or millions of illegals. Though based on how its written you are correct
The Trans issue should have been a 9-0 decision as well
You should read the case and listen to the oral arguments. You would realize you are completely 100% wrong about what the constitutional framers— this is the 14th amendment so doesn’t concern Founding Fathers— intended by the amendment. Given you already stated you don’t read the opinion or listen to the oral arguments it’s unsurprising you are spreading this misinformation.

I have listened to the legal experts on a few channels and the different interpretations of the 14th amendment and folks interpret that differently . The reality is it will take congress to ratify and the Dems will never allow it to be changed .
I am not sure what misinformation I am spreading .

That they did not know what was entailed by the wording of the 14th amendment. This point came up in oral arguments and has been consistently talked about. They absolutely did know what they were doing with the wording.
Downs has studied the history of the Constitution extensively and points out that this concept of birthright citizenship was first defined in the Civil Rights Act of 1866. This law was passed after the end of the U.S. Civil War as a way to affirm the rights of Black Americans who were formerly enslaved.
In addition to legally establishing what defines citizenship, the 14th Amendment guaranteed equal protection under the law. Downs said that free Black Americans led much of this push for clarity because their legal status and protections depended on it.
Downs also said that the framers of the 14th Amendment were very aware of how the text could be interpreted after it became law in part because it was so heavily debated by the time it was passed. The Act was passed twice — it was initially vetoed by President Andrew Johnson, then Congress overrode Johnson’s veto to pass it again.
By the time language about the definition of a citizen and equal protections were incorporated into the 14th Amendment, the law’s intention was crystal clear.
“It's rare for a law to be so heavily debated in Congress and then a chunk of that law to be incorporated into a constitutional amendment,” said Downs. “That's a high level of discernment by very able lawyers to make it beyond doubt that Black formerly enslaved people would be protected.”

See, he is a TV guy. He watches and parrots what they tell him. No one but Trump has a different interpretation.
I skimmed the legislative history portion of the decision because of the concessions made in the oral arguments. Why this decision wasn’t shorter and made at the same time as the national injunction decision is baffling, other than not wanting to upset the king.
The citizenship question should have been 9-0. The text is absolutely ****ing clear. You want to change it, amend the Constitution, *******s.
I suppose we should take some solace that the ridiculous executive order was struck down, but the fact it wasn’t unanimous is alarming, and further evidence the USA is near death.
Europe will die first though. Within twenty years the Mullah's will be in charge of all of Europe.

I basically agree with the article that Steamraise posted.
That said, I suspect SCOTUS has always been driven largely by politics in varying degrees.. Which makes sense, given that it is the politicians who vote them in.
It was before as well but it annoyed a different group when it was more progressive.
I doubt it's possible for a system where a group of 'wise men' interpret a very old piece of paper to be anything else. At best we can hope for them to be very clever and scrupulously ethical. Even that wont change it being a very old piece of paper that can't possibly cover the areas needed to be decided upon in a sensible way. (just for you: at least not when it was written by mere mortals)

Except the 'old piece of paper' contains within it means to amend it (which has happened 15 times), and even contains a mechanism whereby a Constitutional Convention could be called to re-write the whole thing if needed.
The dumbass that thinks he is king can’t just issue a royal decree to change the old piece of paper? Who knew?

Can one blame him? The elites in the GOP who KNOW that’s this isn’t how things are meant to be done keep enabling him.
Look at the Trumptard apologists here. Granted, they’re likely spectrum-dwelling freaks who are societal outliers that are invisible unless they’re at a keyboard, but you see the same **** from mainstream folks. They dismiss and excuse EVERYTHING he does. Why wouldn’t Trump just think he can do whatever the **** he wants?
It was just reported he made a billion $$$ scamming cryptotards. The reaction? No one cares. In fact if it annoys those with ethical scruples, all the better!
It’s been too easy for too many for too long in this country that people have no idea how good we have it and how delicate the balance is. It will take way less than people think to upend it all. But as long as the libs are pwnd it’s all good!
When it all crumbles he’ll be fine, so why should he do anything differently? It’s not like he cares about America or anyone at all but himself.
If you chose him, you’re a ****ing ******.

“I don’t think there’s an appearance problem.”
My wages are not keeping up with Trump’s inflation, but his tards love he’s getting rich. Pathetic ******* zeros.
Look at the Trumptard apologists here ... . They dismiss and excuse EVERYTHING he does.
As long as he discriminates against brown people and non-Christians, they are fine with the rest. They want some confidence that "other" people are on the bottom of the totem pole when the crap hits the fan.
He's the leader of a tribal death cult.
But this tribal loyalty is also not unique to the GOP .... Democrats have it too. No amount of drone bombing, fracking, secret TPP cultivation, expanding inequality or wall street groveling put a dent in Obama's followers.
We're all tribal zombies. Look in the mirror.

Indeed and if as I argue for, progressive usa policy was focused a lot more on changing it then there would be some hope.
Instead it's alll oh just too difficult so let's do **** all instead. And vote for people we don't want while complaining that the system mysteriously keeps delivering what we don't want

In theory, the means of improvement exist.
But the public has long ceded media and mind control to the oligarchics who control the flow of information to them.
The feudal lords have figured out how to disable the public ability to gather and share information.
The lords have purchased the courts which have allowed the lords to corral the subjects into districts in which the local citizens are easily controlled through tribal fear mongering.
American democracy is dead.
I realize my comment might have been the pebble that started this landslide derail, but JFC, for a guy that has all the answers on how to save the world it is amazing that he can’t understand or abide by this forum’s topical categories.
