They were a violent, heavily armed, militant organization that terrorized their neighborhood. The mayor of Philadelphia at the time was an African-American Democrat named Wilson Goode. Dude, they broke down a gate to enter a gated community. That, in and of itself, puts them on private property so the sidewalk is private property. At that point their only recourse against a potential attack would be themselves.
