well importantly if youβre here illegally and are charged with a crime, it doesnβt automatically cause you to lose your citizenship. you still have rights that come attached to having permanent resident status.
an illegal immigrant or someone whose status has lapsed, if charged with a crime, can of course be automatically deported because they are by definition always deportable.
by the way just a technicality but just being in jail doesnβt mean you are guilty of a crime. you can be charged and housed in jail while awaiting your trial. so I do think that we have a duty to pay for their jail while they await due process.
