I am not sure rick, because mental faculty empairment, although more probable in old age, can happen at any time.

I mean you have the splendid 25th amendment which got the idea right. The problem is having an administration nominated by the president you want to kick away being charged with claiming he is not able anymore to do his job.

Perhaps SCOTUS should have that role.

Higher courts will have to determine if the government is right about jurisdiction, once the planes are above international waters, and about the detail of the timing of the injunction (if it has to be registered in the electronic docket to start having validity, or if the moment it is expressed by voice in public is when the clock starts).

Then ofc there is the over-arching topic of all injuctions at the district levels with nationwide implication that don't regard plaintiffs. Sooner or later we hope SCOTUS will say something about that.

I'm seeing these polls and I have to wonder wtf happened to us as a country. Were we this bad all along and we just didn't have someone as bad (or worse) as us run for president? I just don't get it.

These idiots and *******s have always been around. The internet absolutely has contributed to the "rise" of these zeros as it allows them to see that there are other shitbags out there just like them, but Trump is also a huge factor. He has the uncanny ability to coalesce these varying factions of idiots and *******s into a giant club that he is pounding the rest of the country with. No other GOPtard has that gift. (Nor are there any Dems with it.) Not JD Vance. Not Rubio. Not DeSantis. None of them. None of them would have straight up lied about the 2020 election being rigged. Or said the Ukraine started the war. Or any other number of completely insane lies Trump has told. He is completely devoid of shame and empathy. He is one in a billion. A total ****ing monster.

All this **** stops once Trump is dead and gone. Others will surely try to emulate Trump, but they will not be able to. Trump is a force of nature, the likes of which we've never seen. And should be dealt with as such.

It is a bedrock principal of law that the there is no geographical limit to the jurisdiction of the court. Especially not when the government is HERE IN AMERICA still.

Can you name a single example ever of the US government arguing otherwise? Cause the current DOJ didn’t cite anything beyond “inherent Article II authority”

Yes, flag state law usually carry over to aircraft.

Airspace law can be complex, but that is more when multiple nationalities are involved over foreign airspace and a plane can not return to its flag space. When it is a matter of an airplane in international airspace, it is pretty simple. The law of the flag state applies.

As for whether the executive branch should be required to follow a court orders, you are the one who have spent hundreds of posts on this forum stating that the courts are the arbiters of the law, the checks and balance on government overreach. You have even suggested that people who do not comply with the courts should be killed.

This change in argumentation would suggest that you only think it is people you disagree with who should be held to court order, and be extension that only people you disagree should be killed for not adhering to the courts. There are many interesting terms for that, but suffice to say you did not leave libertarianism behind so much as you never bothered with it to begin with.

Other than that, it is certainly true that the executive not following court order is a time-honored tradition in most democracies, though in a healthy democracy it is used sparingly. Techniques include stalling for legislative change, letting funds run out, reorganizing, downsizing staff, ordering new reviews, following the order's letter but not the spirit and so forth.

The problem of course, is that whether this is okay is based on norms and on the presumption that the legislative would step up if it goes out of bonds. The US has abandoned its political norms, and the legislative at this point is run by Trump's most ardent supporters on Twitter. In summary: The US is in a pickle.

Based on the reporting from the hearing that is going on right now, DOJ seems to be arguing that the government did comply because the court's order wasn't posted on the docket until after a couple of the planes landed. That argument that doesn't even pass the red face test. Every lawyer in the world knows that orders from the bench have immediate effect, even if the written ruling isn't posted immediately.

In any case, even if you were to credit the DOJ's argument, surely you would agree that Trump is testing the waters on defying court orders, which is exactly what I told you would happen two months ago. I strongly suggest that you start workshopping your arguments for why the federal government simply doesn't have to comply with federal court orders, because that is where Trump is heading. I don't know how much more evidence you need.
