I am ok with the 2 amendment. sometimes the state can act without being legitimated to do so. that's when armed citizens work as a counter.

Shooting many people on sight sounds like a good example of someone inimical to social order.

shooting many people doing things that are completely against the law in a way that if generalized would bring about the collapse of society is not only reasonable, it is imperative for law enforcement.

the main reason we pay their wages is to assassinate everyone attempting to disrupt society in that way. that's why we allow them to have guns and use them in the first place. that's the whole point of giving the "monopoly" (or superiority) of violence to the state.

nothing during the many peaceful protests by day, in a zillion of places.

shooting to kill by law enforcement every time any kind of violence against property or people started. that usually happened at night.

as with every other protest which turns into a riot.

you know very well after they shoot to kill every single violent monster the first time it completely stops forever right? it takes like 30+ years for anyone in society to even think they could do anything analogous again.

and what you want is for the totality of the population ot not even think they could even evaluate the possibility of being violent against property or people for political purposes, or face automatic and certain death .

that's what a decent society is about. no one even think he could ever achieve anything political with violence without dying immediately


if you want to save the lives of people who end up within a formerly legal protest that turns into a riot, use this:

law enforcement comes with machine guns charged, yells as strongly as it can "you have 10 minutes to disperse", everyone who doesn't go the **** away is mowed down with machine guns and hunted like a rabid dog.

there is nothing extrajudicial in killing violent people en flagrante by law enforcement. it's the purest form of law application.

that's actually one of the first priorities (or should be) of law enforcement: law enforcement being allowed and morally supported to stop criminals in their actions through lethal force is the basis of civil society.

we should literally throw a party to the specific individuals in law enforcement who manage to kill the bad guys and treat them as the heroes that they are when they do so.

killing the bad guys should be considered one of the most moral actions any law enforcement official could do in his career.

why do you think that? the department of education act of 1979 isn't necessarily constitutional.

why do you think congress has unlimited power to create executive agencies? where is that power explicitly listed among congress constitutional powers in the constitution?

again, not really important to the discussion and somewhat of a red herring. I’m trying to isolate if, in principle, congress has the constitutional power to create agencies/offices/departments or not. If it does have that power solely then the president cannot by executive action contravene a department established by law. That’s the real focus here.

If you want to argue constitutionality of the department, then you have to have standing to do so, and that would be decided by the courts not the president.

The talk about regulation is off topic.
