I defend the right of Kimmel (and everyone else) to say whatever he wants (except incitement, which he didn't do) in any platform that is willing to let him speak, without the government going after him with fines or arrests , which didn't happen.

it's always been a grey area but typically out of respect for journalistic integrity the government prosecuted those who leaked the docs not those who published
however there are ample precedents of journalists being threatened with prosecution for things they published but the government ultimately decided not to proceed and of news outlets whose editorial board decided against publishing due to either government pressure against doing so or their own discretion
but these guidelines they issued are not new, they've always been around - they've just never been enforced
it's been illegal to publish state secrets in the USA since 1917
it's also illegal to do so in the uk, in france, in germany, canada, australia, spain, etc etc etc
to equate this to north korea and china like some are doing is extremely naive and outright stupid
now, it is unprecedented for these countries to actively go after journalists as these laws are almost never enforced and it is very troubling that the trump admin is threatening to do so - especially since they can't be trusted to use that power responsibly but rather to bully into everyday censorship etc - but again, let's not pretend like it's not illegal around the world to publish state secrets - because it's not
